ಮೈಸೂರು, ಏಪ್ರಿಲ್ 8: ಮೈಸೂರು ಹೆಚ್ಚುವರಿ ಸಿವಿಲ್ ನ್ಯಾಯಾಧೀಶರು ಮತ್ತು ಜೆಎಂಎಫ್ಸಿ ನ್ಯಾಯಾಲಯದಲ್ಲಿ ವಿಚಾರಣೆಯಲ್ಲಿರುವ ಎಕ್ಸ್ಕ್ಯೂಷನ್ ಕೇಸ್ ನಂ.263/2022 (ಜಯರಾಮು ಆರ್ ವಿರುದ್ಧ ಕರ್ನಾಟಕ ರಾಜ್ಯ) ಪ್ರಕರಣದಲ್ಲಿ ಮಹತ್ವದ ಆದೇಶ ಹೊರಬಂದಿದೆ.
ಪ್ರಕರಣ ಇಂದು ನ್ಯಾಯಾಲಯದ ಮುಂದೆ ಬಂದ ವೇಳೆ, ಜಡಿಆರ್ ನಂ.2 ಪರ ವಕೀಲರು ಸೆಕ್ಷನ್ 151 ಸಿಪಿಸಿ ಅಡಿಯಲ್ಲಿ ಅರ್ಜಿ ಸಲ್ಲಿಸಿ, ಜಿಲ್ಲಾಧಿಕಾರಿ ಲಕ್ಷ್ಮೀಕಾಂತ ರೆಡ್ಡಿ ಅವರ ವಿರುದ್ಧ ಹೊರಡಿಸಿದ್ದ ಬಂಧನ ನೋಟಿಸ್ ಹಿಂಪಡೆಯುವಂತೆ ಮನವಿ ಮಾಡಿದರು. ಇದಕ್ಕೆ ಪ್ರತಿಯಾಗಿ ದಾವಿದಾರರ ಪರ ವಕೀಲರು ಆಕ್ಷೇಪ ವ್ಯಕ್ತಪಡಿಸಿದರು.
ನ್ಯಾಯಾಲಯವು ಈ ಸಂಬಂಧ ಮೂಲ ತೀರ್ಪಾದ ಒಎಸ್ ನಂ.366/2002 (08.02.2021) ಅನ್ನು ಪರಿಶೀಲಿಸಿದ ಬಳಿಕ, ಎಕ್ಸ್ಕ್ಯೂಷನ್ ಅರ್ಜಿಯಲ್ಲಿ ಕೇಳಿರುವ ಪರಿಹಾರವು ತೀರ್ಪಿನೊಂದಿಗೆ ಹೊಂದಿಕೆಯಾಗುವುದಿಲ್ಲ. ಆದ್ದರಿಂದ, ಬಂಧನ ನೋಟಿಸ್ ಜಾರಿಗೊಳಿಸಲು ಯಾವುದೇ ಡಿಕ್ರಿಟಲ್ ಆಧಾರ ಇಲ್ಲವೆಂದು ನ್ಯಾಯಾಲಯ ಅಭಿಪ್ರಾಯಪಟ್ಟಿದೆ.
ಈ ಹಿನ್ನೆಲೆಯಲ್ಲಿ, ಜಡಿಆರ್ ನಂ.2 ಸಲ್ಲಿಸಿದ ಅರ್ಜಿಯನ್ನು ನ್ಯಾಯಾಲಯ ಮಾನ್ಯಗೊಳಿಸಿ, ಜಿಲ್ಲಾಧಿಕಾರಿ ಲಕ್ಷ್ಮೀಕಾಂತ ರೆಡ್ಡಿ ಅವರ ವಿರುದ್ಧ ಹೊರಡಿಸಿದ್ದ ಬಂಧನ ನೋಟಿಸ್ ಅನ್ನು ಹಿಂಪಡೆಯುವಂತೆ ಆದೇಶಿಸಿದೆ.
ಪ್ರಕರಣದ ಮುಂದಿನ ವಿಚಾರಣೆ ಏಪ್ರಿಲ್ 22, 2026 ರಂದು ನಡೆಯಲಿದೆ.

Mysuru, April 8: A significant order has been passed in Execution Case No. 263/2022 (Jayaramu R vs State of Karnataka), being heard at the Court of the Additional Civil Judge and JMFC, Mysuru.
When the case came up for hearing today, the counsel for JDR No. 2 filed an application under Section 151 of CPC seeking recall of the arrest notice issued against Deputy Commissioner Lakshmikant Reddy. The petitioner’s counsel opposed the application.
After examining the original judgment in OS No. 366/2002 dated 08.02.2021, the court observed that the relief sought in the execution petition was not in accordance with the judgment. Therefore, it held that there was no decretal basis to enforce the arrest notice.
Accordingly, the court allowed the application filed by JDR No. 2 and ordered the recall of the arrest notice issued against Deputy Commissioner Lakshmikant Reddy.
The next hearing is scheduled for April 22, 2026.
